# Technology, Information, and Privacy

## Confidential information

Much of the affairs of the Community, including but not limited to information concerning residents and Community business records, is confidential. Our work is undertaken on behalf of our residents in strict confidence and with an understanding of privacy, particularly medical information. Any single incident of disclosure of confidential information will be considered a serious violation of trust. Therefore, the utmost care must be taken by every team member not to discuss or even mention resident or business affairs outside The Arbor Company or even inside the Community if the person to whom you are giving the information does not have a legitimate need to know the information.

During the course of your employment, you may also be working with Community business reporting and computer systems, future plans and other information that we consider confidential. Maintaining this confidentiality is important to our ability to achieve financial success and provide employment stability to our team members.

Such Community confidential information includes, but is not limited to, the following examples:

* Potential resident and lead lists
* Market leads
* Customer preferences
* Vendor and supplier information
* Financial information
* Marketing strategies
* Pending projects and proposals
* Proprietary processes
* Research and development strategies
* Pricing strategies
* Team member salary information and records

You are required to protect this information by safeguarding it when in use, filing it properly and securely when not being used, and discussing it only with those within the Community who have a legitimate business need to know.

Team members who improperly use or disclose residents' information and the Community's confidential business information will be subject to disciplinary action up to and including termination of employment, even if they do not actually benefit from the disclosed information.

## Computers and electronic mail

The Community provides computer software, hardware, computer files and the Arbor.com email system to assist certain team members with access to computers and/or email in completing their job duties as quickly and efficiently as possible. Much of the resident and Community personal, medical and financial information maintained on the computer network is confidential and, while shared among authorized team members, should not be disclosed to unauthorized individuals. This equipment and any other informational, storage or retrieval services that the Community provides are to be used for business purposes and only during your actual working time. All computer passcodes must be available to the Community at all times. Any misuse of the computer software, hardware or email system could result in denial of access to the Community's systems and equipment, and result in termination of employment.

Team members should not install or download personal data or software on any Community equipment. Do not download anything from the internet or open emails from unknown individuals or open files containing large attachments or audio/video segments as these may impede efficient operation of the computer network. Ask for help if you need to open a particular file in order to perform your job duties.

Messages left on Community electronic equipment (such as voicemail, email, and computer and network files), even when a personal password is required, are subject to inspection by the Community. Your password is designed to protect your files and messages from access by other personnel. However, the Community retains the ability to access any electronic or voice file when necessary.

When using the Community's electronic equipment, please be aware of the following rules:

* Obscene, inappropriate, offensive or harassing messages are forbidden.
* Excessive use of the equipment for nonbusiness-related communications, or use other than during actual working time, is forbidden.
* Use of unauthorized codes or passwords to gain access to the files of others is forbidden.
* Unauthorized disclosure and dissemination of resident and Community confidential information is forbidden.

While email can be an informal means of communication, all messages, particularly those sent outside the Community, should be drafted and carefully reviewed before being sent.

These policies are intended to alert Community team members to the need for careful electronic and internet usage at all working times, and is not intended to inhibit normal business communications. In addition, nothing in this policy is intended to interfere with any team member's exercise of any legal rights, including Section 7 rights under the National Labor Relations Act (NLRA).

## Internet guidelines

* The Community may require or permit internet connection for the performance of your job duties. The Community requires all internet connection to be for business purposes. To prevent spreading viruses, violating licensing agreements, etc., team members are prohibited from installing any software, including computer games or access to social networking sites, on company-owned computers. Do not use the Community's computers to access inappropriate or nonbusiness-related websites, social networking sites, chat rooms or blogs, and do not use the computers during nonworking periods.
* You may not use personal laptop computers, iPads/tablets, phones or other communication devices to access email, websites, instant messaging, social media sites, chat rooms or blogs while you are on duty.
* The Community reserves the right to monitor, enter, search, intercept, access, or disclose the internet connections of any team member while at work, without advance notice. Such action will be taken for business purposes such as investigating theft, disclosure of confidential information, personal abuse of the system, or monitoring workflow or productivity.
* The Community prohibits the downloading or playing of games or other application programs onto Community equipment. Such software may not only contain embedded viruses but also may interfere with standard applications.
* Remember, nothing you do on the internet is really private, and your internet surfing is easily detected and can subject your computer, and potentially the Community's entire system, to computer malware, viruses or spyware.
* The Community prohibits participation in web-based surveys or subscription-based services without authorization. Distribution of Community information via the internet is strictly prohibited unless for the benefit of the Community and approved in advance by your Department Head or the Executive Director.

## Monitoring

The Arbor Company reserves the right to enter, search and monitor telephone calls, voicemail, facsimiles, web browser history, the computer files or email of any team member without advance notice. The Company also reserves the right to monitor, enter, search, intercept, access or disclose the internet connections of any team member without advance notice. Such action will be taken for business purposes such as investigating theft, disclosure of confidential information, personal abuse of the system, or monitoring workflow, productivity, and accuracy.

## Social media

The Arbor Company respects your right to utilize social media, but you must bear in mind that the content you produce may have a profound effect on the Community, including its residents, its relationships with potential residents and family members, and its overall well-being. With that in mind, any team member who fails to adhere to any of The Arbor Company's expectations with regard to online social media behavior will be subject to discipline up to and including termination of employment.

**Our Expectations for Team Members' Personal Behavior in Online Social Media:**

* **Ethical Behavior.** Always adhere to the Company's guidelines outlined in the Team Member Handbook. The Company has zero tolerance for behavior that is harassing, discriminatory, offensive, illegal or disparaging of any person or company, and that applies in cyberspace the same as it applies in the workplace.
* **Personal Responsibility.** Remember that YOU are responsible for your actions. If you post anything that may tarnish the Company's image, you will be held responsible as if you had said it at work. If you choose to participate in online social media spaces, we urge you to do so while exercising sound judgment and common sense.
* **Protect Privacy.** Do not, at any time, disclose information that is confidential, including proprietary Community or Company business information, resident and/or family information, photos/videos of residents, supplier and vendor information, other team member's personal information (for which you do not have express permission from that team member to publicly disseminate on social media), marketing pricing information or any other information not generally available to the public.
* **Accuracy.** It is against Company policy to knowingly or recklessly communicate any information about the Company or any of its competitors that is untrue, inaccurate or deceptive.

This Social Media policy is intended to alert Community Team Members to the need for careful use and enjoyment of social media avenues of communication at all times and is not intended to inhibit normal personal communications. In addition, nothing in this policy is intended to interfere with team members' legally protected right to discuss terms and conditions of employment and working conditions or any team member's exercise of any legal rights, including Section 7 rights under the National Labor Relations Act (NLRA).
